Terms of Service

Please read these Terms carefully. By subscribing to or using Penned's services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Get Penned LLC ("Penned," "we," "us," or "our"), governing your access to and use of our website at get-penned.com and our handwritten postcard subscription service (collectively, the "Service").
By accessing our website, creating an account, or subscribing to our Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Our Services
Penned is a personalized handwritten postcard subscription service. We write and mail physical postcards by hand to recipients of your choosing, on a recurring monthly basis. Our services include:
- Monthly handwritten postcards mailed to one or more recipients
- Optional personalization based on details you provide about your recipient
- Choice of signature style (from "Penned," from your name, or a custom signature)
- Domestic and international delivery (standard postage included)
We reserve the right to modify, suspend, or discontinue any aspect of our Service at any time with reasonable notice to active subscribers. We will make reasonable efforts to fulfill all prepaid subscriptions before any service discontinuation.
3. Eligibility
You must be at least 18 years of age to use our Service. By using Penned, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into a binding agreement
- You will use the Service only for lawful purposes
- All information you provide to us is accurate and complete
We do not knowingly collect information from or provide services to individuals under 18 years of age.
4. Subscriptions & Billing
Subscription Plans
We offer the following monthly subscription plans:
- Single Postcard — $10.00/month (1 recipient)
- Two Recipients — $18.00/month (2 postcards)
- The Bundle — $35.00/month (5 postcards)
Billing & Payment
Subscriptions are billed on a recurring monthly basis. Your first payment is due at the time of subscription. Subsequent payments are automatically charged on the same date each month. All payments are processed securely through Stripe. We do not store your payment card information on our servers.
Fulfillment Schedule
Postcards are written and mailed during the first week of each calendar month. Subscriptions initiated after the 15th of a given month will begin fulfillment the following month. Domestic delivery typically takes 3–7 business days. International delivery times vary by destination.
Price Changes
We reserve the right to change our subscription prices. We will provide at least 30 days' notice of any price change to active subscribers via email before the change takes effect.
5. Cancellation & Refund Policy
Cancellation
You may cancel your subscription at any time by contacting us at sales@get-penned.com or through your Stripe customer portal. If you cancel before the 1st of the month, you will not be charged for that month. If you cancel after the 1st of the month and your postcard for that month has already been written and mailed, your cancellation takes effect the following billing cycle.
Refunds
Due to the handcrafted and time-sensitive nature of our service, we generally do not offer refunds once a postcard has been written and mailed for that billing period. However, we handle each situation with care and will work with you to find a fair resolution in the following circumstances:
- Postcard was not delivered due to an incorrect address provided by us
- Service was not fulfilled for a paid billing period
- Billing error or duplicate charge
To request a refund or report an issue, please contact us at sales@get-penned.com within 30 days of the billing date in question.
6. Acceptable Use
You agree to use our Service only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to use our Service to:
- Send postcards containing harassing, threatening, defamatory, obscene, or illegal content
- Send postcards to individuals without their reasonable expectation of receiving mail from your address
- Impersonate any person or entity in a misleading or harmful way
- Violate any applicable local, state, national, or international law or regulation
- Attempt to gain unauthorized access to our systems or interfere with our Service
We reserve the right to refuse or cancel any subscription or order that we believe, in our sole discretion, violates these Terms or may cause harm to any individual or to our business. We will use good judgment in applying this standard and will not cancel subscriptions arbitrarily.
7. User-Provided Content
When you provide us with information about your postcard recipient — including their name, address, personality traits, interests, or personal details — you represent that:
- You have the right to share this information with us for the purpose of fulfilling your subscription
- The information is accurate to the best of your knowledge
- You have the recipient's reasonable expectation that they may receive mail at the provided address
We will use the information you provide solely for the purpose of writing and mailing your postcards. We will not use recipient information for any marketing or other purpose. Please refer to our Privacy Policy for details on how we handle your data.
We retain creative discretion over the content and wording of each postcard, guided by the information you provide and the spirit of your subscription. We write each postcard in good faith to be thoughtful, warm, and appropriate.
8. Intellectual Property
All content on our website — including text, graphics, logos, and design elements — is the property of Get Penned LLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our website content without our written permission.
The handwritten content of each postcard we create is an original creative work. Once mailed, the physical postcard belongs to the recipient. However, Penned retains the right to reference the general style and nature of our work for promotional purposes, without reproducing specific personal content from any individual postcard.
9. Disclaimer of Warranties
Our Service is provided on an "as is" and "as available" basis. While we strive to deliver every postcard on time and with care, we cannot guarantee:
- Specific delivery dates, as postal delivery is handled by third-party carriers (USPS and international postal services)
- That postcards will not be lost, damaged, or delayed in the mail
- Uninterrupted or error-free operation of our website
To the maximum extent permitted by applicable law, Penned disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
10. Limitation of Liability
To the fullest extent permitted by law, Get Penned LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Service.
Our total liability to you for any claims arising under these Terms shall not exceed the total amount you paid to us in the three (3) months preceding the claim. This limitation applies regardless of the form of action and even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.
11. Indemnification
You agree to indemnify, defend, and hold harmless Get Penned LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or related to:
- Your use of our Service
- Your violation of these Terms
- Information you provided to us that was inaccurate or that you did not have the right to share
- Any content requested in your subscription that causes harm to a third party
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or our Service shall first be attempted to be resolved through good faith negotiation between the parties. If we cannot resolve the dispute informally, both parties agree to submit to the exclusive jurisdiction of the state and federal courts located in Hennepin County, Minnesota.
13. Changes to Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Send an email notification to active subscribers at the email address on file
- Provide at least 14 days' notice before changes take effect for active subscriptions
Your continued use of our Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your subscription before the changes take effect.
